Traffic stop leads to impaired charge for ATV driver

A 19-year-old from Kirkland Lake is facing multiple charges

KIRKLAND LAKE – On Aug. 21, 2021, at approximately 2:28 a.m., frontline members of the Kirkland Lake Detachment of the Ontario Provincial Police (OPP) conducted a traffic stop on All-Terrain Vehicle (ATV) in the Town of Kirkland Lake.

The investigation revealed that the driver did not have a licence, the ATV was not insured and that it was being operated in contravention of a Town of Kirkland Lake By Law. Police also determined that the driver was under the influence of alcohol.

As a result, Brandon McAfee, 19-years-of-age, of Kirkland Lake, has been arrested and charged with;

  • Operation while impaired - blood alcohol concentration (80 Plus), contrary to section 320.14(1)(b) of the Criminal Code 
  • Operate a motor vehicle without insurance, contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act 
  • Drive motor vehicle - no licence, contrary to section 32(1) of the Highway Traffic Act 
  • Operate ATV between 11 p.m. and 6 a.m., contrary to the Town of Kirkland Lake By Law (11)(072Sec4)

The driver was issued a 90 day Administrative Driver's Licence Suspension (ADLS).

The accused was released on an Appearance Notice and is scheduled to attend the Ontario Court of Justice in Kirkland Lake on Sept. 30, 2021.
