17-year-old faces impaired driving charges

The Timmins Police Service has charged two persons with impaired driving related Criminal Code offences stemming from two separate incidents that occurred recently in Timmins.

A Timmins Police Service officer responded to a call for service regarding a suspected impaired driver navigating through a fast food restaurant drive-thru lane during the morning hours of Wednesday, May 10.

The staff at the restaurant made observations of the driver’s comportment and called in their suspicions to the Timmins Police for investigation.

The driver was located and was required to provide a breath sample into the approved screening device (ASD).

A “fail” was registered on the device and the driver was subsequently arrested and transported to the police station to complete further breath testing procedures.

Based on the outcome of those tests, a 47-year-old of Cochrane has been charged with:
    •    Impaired operation of a motor vehicle contrary to the Criminal Code of Canada
    •    Operate motor vehicle – concentration in excess of 80 mgs of alcohol per 100 mls of blood contrary to the Criminal Code of Canada

The accused was released from police custody on the strength of an Undertaking compelling her to attend at the Ontario Court of Justice in Timmins on May 23 to address the charges laid against her.

In a separate incident that occurred during the morning hours of May 11, a Timmins Police Service officer had occasion to observe a vehicle fail to stop for the posted STOP sign at the intersection of Birch Street South and Sixth Avenue.

The vehicle was followed and was further observed being driven in an erratic fashion by the officer.

A traffic stop was initiated by the Timmins Police officer on Toke Street and the driver was interviewed.

Based on observations made by the officer, the driver of the vehicle was arrested and taken to the Timmins Police station to complete breath testing procedures.

An open container of liquor was located within the vehicle.

Based on the outcome of the breath tests completed at the police station, a 17-year-old female young person from Peawanuk has been charged with:
    •    Impaired operation of a motor vehicle contrary to the Criminal Code of Canada
    •    Operate motor vehicle – concentration in excess of 80 mgs of alcohol per 100 mls of blood contrary to the Criminal Code of Canada
    •    G1 driver – drive at unlawful hour contrary to the Highway Traffic Act
    •    Novice driver – BAC above zero contrary to the Highway Traffic Act
    •    Disobey stop sign – fail to stop contrary to the Highway Traffic Act
    •    Drive motor vehicle with open container of liquor – contrary to the Liquor Licence Act
    •    Person under 19 – consume liquor – contrary to the Liquor Licence Act
    •    Person under 19 – obtain liquor – contrary to the Liquor Licence Act

The accused was released from police custody on the strength of an Undertaking compelling her to attend at the Ontario Court of Justice in Timmins on May 29 to address these charges laid against her.
