Two charged after break-in near Kapuskasing

KAPUSKASING – On Sept. 21, 2020 members James Bay Detachments of the Ontario Provincial Police (OPP) were called to investigate a break and enter at a commercial property in Opasatika, west of Kapuskasing.  

As a result of the investigation two people have been arrested and charged.  

James Warner, age 44 of Opasatika Township was charged with the following:   

  • Possession property obtained by crime under $5000 contrary to section 354(1)(a) of the Criminal Code (CC)  
  • Theft under $5000 contrary to section 334(b) of the CC,  
  • Possession of weapon for dangerous purpose contrary to section 88 of the CC  
  • Possession break in instruments contrary to section 351(1) of the CC 
  • Possession of firearm or ammunition contrary to Prohibition Order contrary to section 117.01(1) of the CC; and  
  • Break, enter a place - commit indictable offence contrary to section 348(1)(b) of the CC.  

Heather Lyons, age 45 of Opasatika Township was charged with the following:    

  • Possession property obtained by crime under $5000 contrary to section 354(1)(a) of the Criminal Code (CC) 
  • Theft under $5000 contrary to section 334(b) of the CC,  
  • Possession of weapon for dangerous purpose contrary to section 88 of the CC 
  • Possession break in instruments contrary to section 351(1) of the CC  
  • Break, enter a place - commit indictable offence contrary to section 348(1)(b) of the CC.  

Both accused were released on an Undertaking and are scheduled to appear before the Ontario Court of Justice in Kapuskasing on Nov. 16, 2020.
