Traffic complaint leads to impaired charge near Hearst

A 41-year-old is facing other charges as well

On Nov. 15, 2021, members of the James Bay Detachments of the Ontario Provincial Police (OPP) received a traffic complaint regarding a possible impaired driver on Highway 11, east of Hearst.

Police located the motor vehicle and spoke to the driver. Further investigation revealed that the driver was found to be impaired by drug. As a result, the driver was arrested, driver's licence suspended, and the vehicle was towed and impounded.

Kevin McPhee, 41-years-old of Garson, Ontario, was arrested and charged with:

  • Operation While Impaired - Alcohol and Drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Obstruct Peace Officer, contrary to section 129(a) of the CC
  • Failure to Comply with Release Order - Other than to Attend Court, contrary to section 145(5)(a) of the CC
  • Driving while Under Suspension, contrary to section 53(1) of the Highway Traffic Act

The accused is scheduled to appear before the Ontario Court of Justice on Dec. 1, 2021 in Hearst.
