The Timmins Police Service has charged a Moonbeam, Ontario man with Impaired Driving related Criminal Code offences stemming from an incident that occurred during the early evening hours of Sunday, Aug. 29 in Timmins.
While on patrol in South Porcupine, a Timmins Police officer observed a Kia passenger vehicle being driven at a high rate of speed on Harold Avenue. A traffic stop was initiated by the officer and a quantity of controlled substances along with an open container of beer was observed and located within the vehicle. Based on the outcome of a Standard Field Sobriety Test (SFST), the driver was arrested and taken into police custody.
The driver was transported to the Timmins Police station for the purposes of completing further Drug Recognition Expert (DRE) testing.
Further investigation revealed that the driver is bound by court imposed conditions in keeping with a probation order which he was found to be in breach of.
Based on the outcome of the testing, Pierre Lecuyer, 50, of Moonbeam, has been charged with:
- Impaired operation of a motor vehicle contrary to the Criminal Code of Canada
- Fail to comply with probation order contrary to the Criminal Code of Canada
- Race a motor vehicle – stunt driving contrary to the Highway Traffic Act
- Drive motor vehicle – open container of liquor contrary to the Liquor Licence Act
- Possession of a controlled substance contrary to the Controlled Drug and Substances Act
- Fail to apply for permit on becoming owner contrary to the Highway Traffic Act
The accused was released from police custody on the strength of an Undertaking compelling him to attend at the Ontario Court of Justice in Timmins on Sept. 21 to address the charges laid against him.
