Man accused of drug impaired driving, assaulting two police officers in Smooth Rock Falls

TOWN OF SMOOTH ROCK FALLS - On Dec. 27, 2020 at 12:26 p.m. members of the James Bay Detachment of the Ontario Provincial Police (OPP) responded to a 911 call for a person in medical distress at the Smooth Rock Falls Hospital. 

Police attended and located the person in the emergency department. Investigation revealed the person had been driving under the influence of drugs. The person refused to comply with the Standard Field Sobriety Test (SFST) demand. 

During the arrest, a physical altercation ensued between the person and police. Two officers sustained minor injuries. 

As a result, Martin Cyr, 33 years old, of Val Rita was arrested and has been charged with:

  •  Failure or refusal to comply with demand, contrary to section 320.15(1) of the Criminal Code of Canada (CC),
  • 2x Assault a peace officer, contrary to section 270(1)(a) of the CC,
  • Assault with intent to resist arrest, contrary to section 270(1)(b) of the CC,
  • Fail to comply with probation order, contrary to section 733.1(1) of the CC,
  • Driving while under suspension, contrary to section 53(1) of the Highway Traffic Act (HTA),
  • Class G1 licence holder - unaccompanied by qualified driver, contrary to Ontario Regulation 340/94 section 5(1) of the HTA,
  • Drive vehicle or boat with cannabis readily available, contrary to section 12(1) of the Cannabis Control Act 2017 (CCA), and
  • Possess unmarked cigarettes, contrary to section 29(2) of the Tobacco Tax Act (TTA).
