MCGARRY TOWNSHIP - On Sept. 23, 2021, members of the Kirkland Lake Detachment of the Ontario Provincial Police (OPP) responded to a report of a person uttering threats to people at a seasonal property in McGarry Township.
Further investigation revealed that the accused was breaching their release conditions.
As a result of the investigation, Kevin Theriault, 33 years of age of Kirkland Lake, was arrested and charged with:
• assault with a weapon, contrary to section 267(a) of the Criminal Code (CC) (two counts)
• uttering threats - cause death or bodily harm - contrary to section 264.1(1)(a) of the CC (two counts)
• uttering threats - damage to property - contrary to section 264.1(1)(b) of the CC
• failure to comply with undertaking, contrary to section 145(4)(a) of the CC
The accused was released on an Judicial Release Order and is scheduled to attend the Ontario Court of Justice in Kirkland Lake on Oct. 28, 2021.
