Impaired driving charges laid after traffic stop

26-year-old from Iroquois Falls had vehicle impounded, served 90-day licence suspension

On April 4, 2022 at approximately 10:17 p.m., members of the Iroquois Falls Detachment of the Ontario Provincial Police (OPP) conducted a traffic stop on Highway 67 in Iroquois Falls.

As a result of the investigation Cody Smart, 26 years-old of Iroquois Falls was arrested and charged with the following:

  • Operation while impaired - alcohol and drugs contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Possession of a Schedule I substance - methamphetamine contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA)
  • Possession of illicit cannabis contrary to section 8(1)(b) of the Cannabis Act (CA)
  • Drive vehicle or boat with cannabis readily available contrary to section 12(1) of the Cannabis Control Act (CCA2017)
  • Fail to surrender permit for motor vehicle contrary to section 7(5)(a) of the Highway Traffic Act (HTA)

The driver was served a 90-day administrative driver's licence suspension (ADLS) and the vehicle was impounded for seven days.

The accused was released on an appearance notice and is scheduled to appear before the Ontario Court of Justice on June 16, 2022 in Timmins.
