Driver faces numerous charges after ATV stopped by OPP

On Jan.  17, 2020 at approximately 8:09 p.m., members of the Kirkland Lake Detachment of the Ontario Provincial Police were on patrol in the Town of Larder Lake, Ont., and conducted a traffic stop on an all-terrain vehicle for a safety equipment violation.

Further investigation revealed the driver was under the influence of alcohol and that they were prohibited from driving a motor vehicle.

As a result, Lee Collins, 37 years old of Larder Lake, Ont., has been charged with the following:

  • Operation while impaired - alcohol, contrary to section 320.14(1)(a) of the Criminal Code (CC),
  • Operation while impaired - blood alcohol concentration (80 plus), contrary to section 320.14(1)(b) of the CC,
  • Operation while prohibited under the criminal code, contrary to section 320.18(1)(a) of the CC (two counts) ,
  • Driving while under suspension, contrary to section 53(1) of the Highway Traffic Act (HTA) (two counts),
  • Drive motor vehicle, no plates, contrary to section 7(1)(b)(i) of the HTA,
  • Operate a motor vehicle without insurance, contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act (CAIA), and
  • Fail to wear proper helmet, contrary to section 19(1) of the Off Road Vehicles Act (ORVA).

The driver was issued a 90-day administrative driver's licence suspension and the motor vehicle was impounded for 90 days.

The accused was released on an undertaking and is scheduled to appear before the Ontario Court of Justice on Feb. 13, 2020, in Kirkland Lake.

Remember, any amount of alcohol or drugs can impair one's ability to drive.
