Driver charged following traffic complaint in Porcupine

The 24-year-old faces multiple charges

SOUTH PORCUPINE — On May 15, 2022 at approximately 7:35 a.m., members of the South Porcupine Detachment of the Ontario Provincial Police (OPP) responded to a traffic complaint on Highway 101 in Whitney Township, east of South Porcupine.

As a result of the investigation, Nakita Cardinal, 24 years-old, of Timmins was arrested and charged with the following:

  • Operation while impaired alcohol and drugs contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Operation while prohibited under the Criminal Code contrary to section 320.18(1)(a) of the CC
  • Fail to comply with probation order contrary to section 733.1(1) of the CC
  • Possession of a Schedule I substance - cocaine contrary to section 4(1) of the Controlled Drugs and Substances Act (CDSA)
  • Driving while under suspension contrary to section 53(1) of the Highway Traffic Act (HTA)
  • Fail to surrender permit for motor vehicle contrary to section 7(5)(a) of the HTA
  • Use plates not authorized for vehicle contrary to section 12(1)(d) of the HTA
  • Operate a motor vehicle without insurance contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act (CAIA)

The driver was served a 90-day Administrative Driver's Licence Suspension (ADLS) and the vehicle was impounded for 45 days.

The accused was released on an undertaking and is scheduled to appear before the Ontario Court of Justice in Timmins on June 23, 2022.
