Two impaired charges laid in Hearst

A commercial motor vehicle and a passenger vehicle were impounded for seven days each in the unrelated incidents

HEARST - On Oct. 25, 2018, at approximately 4:15 p.m., Hearst officers of the Ontario Provincial Police (OPP) responded to traffic complaints on Front Street in the Town of Hearst, Ontario. Witnesses reported that the driver of a Commercial Motor Vehicle (CMV) could possibly be impaired.

Police located the driver on Highway 11 in Kendall Township, east of the Town of Hearst and he was subsequently arrested.

Sathiyanathan Maheswaran, 34 years of age, from Scarborough, Ontario was arrested and charged with the following offences:

  • Driving While Ability Impaired - Motor Vehicle (Alcohol) contrary to section 253(1)(a) of the Criminal Code of Canada (CC);
  • Fail or Refuse to Provide Sample contrary to section 254(5) CC;
  • Mischief Under $5,000 contrary to section 430(4) CC;
  • Having Care and Control of a Motor Vehicle with Unsealed Container of Liquor contrary to section 32(1) of the Liquor Licence Act (LLA);
  • Fail to Accurately Complete Daily Inspection Report contrary to section 107(5) of the Highway Traffic Act (HTA);
  • Fail to Maintain Daily Log contrary to section 190(3) HTA.

On Oct. 28, 2018, at approximately 2:45 a.m., Hearst officers of the Ontario Provincial Police (OPP) observed an erratic driver on Edward Street in the Town of Hearst, Ontario. The motor vehicle was intercepted and it was determined that the male driver was impaired by alcohol.

Ross Ekstrom, 24 years of age, from Hearst, Ontario was arrested and charged with the following offences:

  • Driving While Ability Impaired - Motor Vehicle (Alcohol) contrary to section 253(1)(a) of the Criminal Code of Canada (CC);
  • Driving with More Than 80 milligrams of Alcohol in Blood contrary to section 253(1)(b) CC.

The accused persons were served with a 90 day Administrative Driver's Licence Suspension (ADLS) and the motor vehicles were impounded for seven days. They are scheduled to appear at the Ontario Court of Justice in Hearst, Ontario on Nov. 21, 2018.
