Some of the sexual assault and forcible confinement charges laid against a Timmins doctor have been withdrawn by prosecutors.
Dr. Ali Mahmoudi, an orthopedic surgeon who had privileges at Timmins and District Hospital (TADH), was originally charged last July with 10 offences, including two counts each of assault, sexual assault and sexual assault causing bodily harm. Later that year, Timmins police charged Mahmoudi with 11 additional offences related to five more alleged victims.
During a court appearance in Timmins on July 18, 2023, the Crown attorney withdrew the original 10 charges, said Sarah Strban of Henein Hutchison Robitaille LLP, the Toronto law firm that is representing Mahmoudi.
Strban told TimminsToday that the Crown said “they did not have any reasonable prospect of convicting [Mahmoudi]” on the initial 10 charges. The 11 follow-up charges remain before the courts and “will be vigorously defended," said Strban.
None of the allegations have been tested in court and Mahmoudi is considered innocent unless proven guilty.
