Sobriety check leads to impaired charge

The driver was served a 90-day Administrative Driver Licence Suspension and his motor vehicles have been impounded for seven days

On Aug. 26, 2019 at 9:30 p.m., members of the Kirkland Lake Detachment of the Ontario Provincial Police conducted a sobriety check on a driver of a motor vehicle on Carter Avenue in the Town of Kirkland Lake. Further investigation revealed that the driver was under the influence alcohol. 

As a result, Adam Emberley, 46 years of age, of Kirkland Lake, Ontario, was charged with the following:  

  • Operation while impaired - alcohol, contrary to section 320.14 (1)(a) of the Criminal Code (CC), and
  • Operation while impaired - blood alcohol concentration (80 plus), contrary to section 320.14 (1)(b) of the CC.

The driver was served a 90-day Administrative Driver Licence Suspension (ADLS) and his motor vehicles have been impounded for seven days.

The accused was released on a Promise to Appear and is scheduled to appear before the Ontario Court of Justice on Sept. 26, 2019 in Kirkland Lake.
