KAPUSKASING – On Nov. 22, 2016, at approximately 2:20 p.m., members of the Kapuskasing Ontario Provincial Police (OPP) attempted to initiate a traffic stop for a Highway Traffic Act (HTA) offence on Government Road.
The driver failed to stop for police and a pursuit ensued. After the discontinuation of the pursuit, the blue minivan was located on town property off of Concession Road 1 in the Town of Val Rita.
Police located the male driver and two passengers, one male and one female, in a wooded area north of where the minivan had been left.
The male driver, 16, of Toronto, Ontario, was arrested and charged under the Youth Criminal Justice Act (YCJA) and the Highway Traffic Act (HTA) with the following offences:
- Dangerous Operation of Motor Vehicle contrary to section 249(1)(a) of the Criminal Code of Canada (CC),
- Possession of Property Obtained by Crime Under $5000 contrary to section 354(1)(a) CC,
- Flight While Pursued by Peace Officer contrary to section 249.1(1) CC,
- Mischief Under $5,000 contrary to section 430(4) CC,
- Obstruct Peace Officer contrary to section 129(a) CC,
- Race a Motor Vehicle – Stunt contrary to section 172(1) HTA,
- Driver Fail to Surrender Licence contrary to section 33(1) HTA,
- Class G1 Licence Holder – Unaccompanied by Qualified Driver contrary to section 5(1) – O.Reg 340/94 HTA, and with
- Use Plate Not Authorized for Vehicle contrary to section 12(1)(d) HTA (two counts).
The driver was released on a Recognizance of Bail and is scheduled to appear at the Ontario Court of Justice in Kapuskasing on Jan. 9, 2017 to answer to the charges. Both passengers were released from custody without any charges.
