Collision leads to impaired charge

SOUTH PORCUPINE – On Sept. 16, 2016 at 1:56 a.m., South Porcupine Ontario Provincial Police (OPP) responded to a single motor vehicle collision on Highway 655 in Wark Township.

As a result of the officer’s investigation, Martin Gagne, 25, from Sudbury was arrested and charged with Fail/Refuse to Provide Breath Sample, contrary to section 254(5) of the Criminal Code. The accused was later released on a Promise to Appear and Undertaking. 

The accused is scheduled to appear at the Ontario Court of Justice in Timmins on Nov. 1, 2016 to answer to his charge. His driver’s licence was suspended for 90 days and the vehicle he was driving was impounded for seven days.

The OPP are reminding motorists that there is no safe amount of alcohol consumption when driving. Anyone who suspects a driver that is driving while impaired is urged to call police by dialing 9-1-1 immediately.
