Prohibited driver accused of operating a motorized snow vehicle in Kirkland Lake

Police say the accused was not wearing a helmet and did not have insurance

KIRKLAND LAKE - On Jan. 18, 2020, members of the Kirkland Lake Detachment of the Ontario Provincial Police (OPP) were on patrol in the Town of Kirkland Lake, Ont., and conducted a traffic stop on a motorized snow vehicle (MSV). Further investigation revealed that the operator of the MSV was prohibited from driving.

As a result, Joshua Legacy, age 31, of Kirkland Lake, Ont., has been charge with the following:

  • Operation while prohibited, contrary to section 320.18(1)(a) of the Criminal Code (CC) (two counts),
  • Allegation of breach of conditional sentence order, contrary to section 742.6 of the CC (two counts),
  • Drive - no insurance, contrary to section 12(1) of the Motorized Snow Vehicles Act (MSVA),
  • Drive MSV while license suspended, contrary to section 17.1(11) of the MSVA (three counts),
  • Owner - drive MSV, permit not issued, contrary to section 2(1)(a) of the MSVA,
  • Fail to wear proper helmet, contrary to section 20(1) of the MSVA, and
  • Fail to notify change of ownership, contrary to section 3(3) of the MSVA.

The accused was remanded into custody pending bail and is scheduled to appear before the Ontario Court of Justice in Temiskaming Shores, on Jan. 31, 2020.
