Hearst ATVer charged with impaired

Police say they received a traffic complaint about a possible impaired driver and investigated

On June 12, 2021, members of the James Bay Detachments of the Ontario Provincial Police received a traffic complaint regarding a possible impaired driver on an All-Terrain Vehicle.

Police located the ATV and spoke to the driver. Further investigation revealed that the driver was found to have consumed alcoholic beverages. As a result, the driver was arrested, driver's licence suspended, and the ATV was towed and impounded.

 Yvan Bray, 49-years-old of Hearst, was arrested and charged with:

  • Operation while prohibited under the Criminal Code (two counts), contrary to section 320.18(1)(a) of the Criminal Code (CC)
  • Operate a motor vehicle without insurance, contrary to section 2(1)(a) of the Compulsory Automobile Insurance Act
  • Drive while under suspension, contrary to section 53(1) of the Highway Traffic Act (HTA)

The accused is scheduled to appear before the Ontario Court of Justice on July 28, 2021 in Hearst.
