Englehart resident accused of sleeping at the wheel faces drug trafficking charge

Police say the 49-year-old was known to be prohibited from driving Canada-wide

ARMSTRONG TWP – On January 21, 2021 at 10:30 p.m., members of the Temiskaming Detachment of the Ontario Provincial Police (OPP) responded to a call for a well-being check on Tenth Street East, in the Township of Armstrong. 

Preliminary investigation revealed that a vehicle had been idling in a parking lot and the driver appeared to be asleep. 

Police attended and arrested the driver, who was known to be prohibited from driving Canada-wide.

Incident to arrest, the driver was also located with a quantity of suspected controlled substances.

Dwayne Nelson, a 49-year-old resident of Englehart, is charged with: 

  • Operation while prohibited under the Criminal Code (CC), contrary to section 320.18(1)(a) of the CC (four counts), 
  • Possession of a schedule I substance for the purpose of trafficking - Methamphetamine, contrary to section 5(2) of the Controlled Drugs and Substances Act (CDSA), 
  • Fail to comply with probation order, contrary to section 733.1(1) of the CC (two counts), and 
  • Driving while under suspension - section 53(1) of the Highway Traffic Act (HTA) (three counts).

The accused was held for a bail hearing and is scheduled to appear at the Ontario Court of Justice at a later date in the City of Temiskaming Shores.
