Driver faces impaired charges following traffic complaint in Kapuskasing

On March 13, 2022, members of the James Bay Detachments of the Ontario Provincial Police (OPP) received a traffic complaint regarding a possible impaired driver on Government Road, in the Town of Kapuskasing.

Police located the motor vehicle described on Huron Street, and spoke to the driver. Further investigation revealed that the driver was found to have consumed alcoholic beverages.

As a result, the driver was arrested, driver's licence suspended, the vehicle was towed and impounded.

Andrew Arnburg, 22-years-old of Kapuskasing, was arrested and charged with:

  • Operation while impaired - Alcohol and Drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Operation while impaired - Blood Alcohol Concentration (BAC) (80 plus), contrary to section 320.14(1)(b) of the CC
  • Careless driving, contrary to section 130(1) of the Highway Traffic Act (HTA)
  • Possess more than one licence, contrary to section 35(1)(e) of the HTA
  • Novice driver - BAC above zero, contrary to section 44.1(3) of the HTA
  • Novice driver fail to surrender licence, contrary to section 48.1(5) of the HTA

The accused is scheduled to appear before the Ontario Court of Justice on May 2, 2022 in Kapuskasing.
