Commercial driver charged with impaired on Highway 11 east of Hearst

Police say they responded to complaints of a commercial motor vehicle driving unsafely on the highway

HEARST - On June 4, 2021, members of the James Bay Detachments of the Ontario Provincial Police (OPP) received numerous traffic complaints regarding a commercial motor vehicle (CMV) driving unsafely on Highway 11, east of Hearst.

Police located the CMV and spoke to the driver. Further investigation revealed that the driver was found to be impaired by drug.

As a result, the driver was arrested, driver's licence suspended, and the vehicle was towed and impounded.

Brett Smith, 46 years old of Oshawa, was arrested and charged with:

  • Operation while impaired - alcohol and drugs, contrary to section 320.14(1)(a) of the Criminal Code (CC)
  • Dangerous operation, contrary to section 320.13(1) of the CC
  • Drive after 16 hours since last break without eight hours off, contrary to O.Reg 555/60 section 9(3) of the Highway Traffic Act (HTA)
  • Driver of commercial motor vehicle - fail to carry proof of insurance, contrary to section 23(3) of the HTA

The accused is scheduled to appear before the Ontario Court of Justice on July 28, 2021 in Hearst.
