Two charged following Kirkland Lake break and enter

When police arrived on the scene, they found the occupant arguing with a person they found in their apartment

KIRKLAND LAKE - On Oct. 12, 2019, members of the Kirkland Lake Detachment of the Ontario Provincial Police (OPP) responded to a disturbance at an apartment building on Kirkpatrick Avenue in the Town of Kirkland Lake.

Police arrived to the scene and began an investigation which revealed that the occupant was arguing with a person that they found in their apartment.

As a result of the police investigation, two people have been charged.

Kenneth Vandeberg, age 52, of Kirkland Lake, Ontario, has been charged with the following:

  • Break, enter a dwelling house with intent to commit indictable offence, contrary to section 348(1)(a) of the Criminal Code (CC),
  • Theft under $5000, contrary to section 334(b) of the CC,
  • Mischief under $5000, contrary to section 430(4) of the CC, and
  • Fail to comply with probation order (two counts), contrary to section 733.1(1) of the CC.

Darcy Shail, age 37, of Kirkland Lake, Ontario, has been charged with the following:

  • Break, enter a dwelling house with Intent to commit indictable offence, contrary to section 348(1)(a) of the CC,
  • Theft under $5000, contrary to section 334(b) of the CC, and
  • Mischief under $5000, contrary to section 430(4) of the CC.

Both accused were released by means of a Promise to Appear and are scheduled to appear before the Ontario Court of Justice on Nov. 28, 2019, in Kirkland Lake.
