SIU ends investigation into incident at local coffee shop

A suspect broke his ankle while trying to flee from police, according to the agency that investigates serious police-involved incidents

An investigation into an arrest in Timmins where the suspect broke his ankle trying to flee from police has ended. 

The Special Investigations Unit director Joseph Martino announced today that the agency has closed the file on the incident that happened last month. 

The SIU is an arms-length agency that investigates police-involved incidents where there has been a death, serious injury, allegations of sexual assault, or the discharge of a firearm at a person.

On Feb. 20, 2023, Martino's statement says a 41-year-old man broke his ankle while trying to flee from officers at the McIntyre Coffee Shop. 

Officers tried to arrest the man, who had a warrant out for his arrest. 

"The man rose to his feet and turned his back as if preparing to surrender his hands to be handcuffed. Before the officer could handcuff him, the man fled and slipped at the front door, breaking his right ankle. The officer followed and slipped, falling on top of the man. The man was arrested and taken to hospital," reads the SIU news release.

After viewing video footage of the incident, Martino was "satisfied the investigation should be discontinued as there was patently nothing to investigate as far as the potential criminal liability of the officer involved. Accordingly, the file has been closed."
