Erratic driving leads to impaired charge for Chapleau driver

The Timmins Police Service has charged a Chapleau, Ont. man stemming from an erratic driving complaint received during the early afternoon hours of Monday, April 15.

A Timmins Police Service officer who responded to the call for service alertly located the vehicle described in the original complaint related to unsafe driving on Hwy 101 in the west end of the City of Timmins.

Upon interviewing the driver, the officer completed an assessment of the driver’s sobriety and called in a second officer to complete standard field sobriety testing procedures.

The driver was required to provide a breath sample into the approved screening device as well.

Based on the outcome of these testing procedures, the driver was arrested and taken into police custody in order to complete Intoxilyzer breath testing procedures.

As a result of this incident, Jacques Nicol, 56, of Chapleau, Ont., has been charged with:
    •    Impaired operation of a motor vehicle contrary to the Criminal Code of Canada
    •    Operate motor vehicle – blood alcohol concentration in excess of 80 mgs contrary to the Criminal Code of Canada

The driver was served with Provincial Offence Notices for:
    •    Fail to surrender permit for motor vehicle contrary to the Highway Traffic Act
    •    Fail to surrender insurance card contrary to the Compulsory Automobile Insurance Act

The accused was released from police custody but must attend at Provincial Court in Timmins on April 30, 2019 to answer to the charge laid against him.
