Assault, mischief charges laid after domestic disturbance in Cobalt

Police say the accused caused further mischief by spreading waste matter in the cell area while in police custody

COBALT - On April 14, 2021 shortly after 2:30 p.m. members of the Temiskaming Detachment of the Ontario Provincial Police (OPP) responded to a domestic disturbance at a residence on Prospect Avenue in the Town of Cobalt. 

Further investigation revealed that a victim was assaulted and the individual was strewing things around inside the residence.

A short time after, police located the individual and he was placed under arrest. The accused immediately became belligerent and combative refusing to comply with officers. An altercation ensued, resulting in two officers being assaulted.

The accused was transported to detachment for processing. While in police custody, the accused caused further mischief by spreading waste matter in the cell area.

A 24-year-old resident of Temiskaming Shores, is charged with:

  • Assault - spousal, contrary to section 266 of the Criminal Code (CC),
  • Mischief - interfere with lawful use, enjoyment or operation of property - under $5,000, contrary to section 430(4) of the CC,
  • Assault with intent to resist arrest, contrary to section 270(1)(b) of the CC,
  • Assault a peace officer, contrary to section 270(1)(a) of the Criminal Code (CC) (two counts),
  • Uttering threats - cause death or bodily harm - spousal, contrary to section 264.1(1)(a) of the CC (two counts),
  • Mischief under $5,000, contrary to section 430(4) of the CC, and
  • Failure to comply with release order - other than to attend court, contrary to section 145(5)(a) of the CC (two counts).

The accused was held for a bail hearing and is scheduled to appear at the Ontario Court of Justice at a later date in the City of Temiskaming Shores.

The OPP will not be releasing the name of the accused in order to protect the identity of the victim.
