NEWS RELEASES

CANNABIS CRUSADERS
AND
RALLY AGAINST S 462.2

***************************
Cannabis crusaders coming to Kirkland Lake On Monday, March 2, cannabis crusaders are coming to Kirkland Lake, to rally support for the Tripping Daisy store.

Dana Larsen, founder of west coast cannabis reform group Sensible BC, and Matt Mernagh, Toronto medical cannabis activist, will be leading a rally at 5 p.m. at the Tripping Daisy storefront, including a march to OPP Headquarters.

On February 5, Kirkland Lake OPP raided the Tripping Daisy store, seizing about $25,000 in bongs, pipes, grinders, vaporizers and other merchandise.

Store owner Darren Delaney was charged on February 11, after his lawyer made an application to have the seized items returned.

Delaney was charged under section 462.2 of the Criminal Code, which bans "instruments or literature for illicit drug use."

The literature ban was deemed to be unconstitutional by the Ontario courts in 1995, but the ban on "instruments" has never been challenged in court.

Section 462.2 is considered a weak law and is rarely enforced.

Bongs and pipes are sold in hundreds of stores across Canada, including from mainstream locations like Petro Canada gas stations.

Darren Delaney has said he will go to court and challenge the Section 462.2 law against bongs and vaporizers.

"We welcome this chance to challenge the law," said Dana Larsen. "We'll be fundraising from stores across the country to support this case. The ban on medical cannabis devices like waterpipes and vaporizers is clearly unconstitutional. When we beat this in court, these kinds of raids will be put to an end once and for all."

"Police officers in most jurisdictions don't bother to enforce this silly law at all," said Larsen. "Apparently the police in Kirkland Lake have solved every other crime in town if they have the time to make the local bong shop a top priority."
